We provide direct-response performance advertising operations — including campaign setup, media buying, optimization, attribution, and reporting — on platforms including TikTok. We operate advertising activity for our own account and, where separately contracted, on behalf of advertisers with their express authorization.
The content of the Site is provided for general informational purposes only. It does not constitute a contractual offer and we make no warranty that the Site will be available at all times, free of errors, or that any particular outcome will result from engaging our services.
Where we operate advertising campaigns through platform APIs (including the TikTok Marketing API), we do so under the terms of the relevant platform's developer agreement. We use these integrations exclusively for the operation of advertising campaigns in which we have a direct interest or for which we are authorized by the advertiser. We do not resell API access, do not provide white-label platform access to third parties, and do not retain or reprocess platform data outside the stated advertising purpose.
Our handling of personal data is described in the Privacy Policy, which is incorporated into these terms by reference. Where we process data on behalf of a merchant advertiser, the data handling practices of that merchant govern the end-user relationship.
All content on the Site, including text, design, and layout, is owned by us or licensed to us. You may view and link to the Site but may not reproduce, modify, or republish its content without written permission.
The Site may link to third-party websites. We are not responsible for the content or availability of third-party sites and inclusion of a link does not imply endorsement.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site or the services described on it. Our total liability for any claim arising from engagement of our services is limited to the fees paid by the claimant to us in the three months preceding the claim.

These terms are governed by the laws of the jurisdiction in which McCarthy King is operated. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
